
To obtain the residential permit in Thailand according to the Immigration Act, B.E. 2522 (1979) and the Notification from Minister of interior by approval of the cabinet, there are the quota and the stipulations for foreigners who desire to apply for the Residential Permit.
Quota
- 100 persons of each nationality, Colony or colonies of each country shall be considered as one country while each Sovereign state shall be considered as one country and
- 50 persons for stateless people
- The application can be submitted every year on the date of announcement of Immigration, in 2020 the submiited date is 1st October, 2020 – 30th December, 2020

Criterias and conditions of foreign nationals’ residential permit consideration
To facilitate an immigration of foreign nationals for the best interest of the Kingdom, the Immigration commission stipulated the following criteria on qualification of foreign applicant for residential permit by considering the applicant’s income, assets, knowledge, vocational ability, and family status in terms of connection with Thai national, conditions on national security or others as deem appropriate for current economic and social condition and to make it also certain that such consideration was made thoughtfully, transparently and fairly.

Qualifications
A foreign national may qualify to apply for a residence permit if he/she
- holds a passport of his/her current nationality, which was granted a NON-IMMIGRANT VISA and has been permitted to stay in the Kingdom ofThailand on the basis of one year visa extension for the total of at least 3 consecutive years up to the application submission date.
- Has personal qualifications that fit one of the following categories:
- Investment category
- Working/Business category
- Humanity Reasons category: he/she must have relationship with a Thai citizen or an alien who already possessed residence permit as the followings:
- A legal husband or wife.
- A legal father or mother.
- A child who is under 20 years of age up to the application submission date and must be single.
- Expert category
- Extra circumstances on a case by case basis

Submission period
Ministry of Interior will announce the annual quota of foreigns to be granted with residence permit and such announcement will be published in the Government Gazette. Application can then be submitted until the last working day of the year. Procedures after the applications are accepted
- The immigration officers will grant the applicants for 180 days extension of stay on the date of application submission first and the next extension will be granted for 180 days until the results of the applications come out from The Immigration Commission.
- The applicants and those who get involved with the applications will get an appointment card to come for an interview with the immigration officers. The interview includes the test of the understanding of Thai language: speaking and listening (the applicants must come for the interview on the date of appointment; otherwise, without an appropriate reason, it will be automatically taken into the consideration that they cancel the applications.)
- The applicants who are 14 years of age up to the application submission date must be checked their criminal records as the followings:
- Their fingerprint sheets are sent to the Criminal Records Division for the criminal records check in Thailand.
- Their passports are checked by the blacklist system whether they are considered as “prohibited persons” according to the Immigration Bureau.
- They are to be checked whether they are wanted by a foreign warrant of arrest by the Foreign Affairs Division.

Government Fee
- A non-refundable fee for each application is 7,600 THB. (whether permission is granted or not. Application fee is not refundable.)
- If the application is approved, the fee for the residence permit is 191,400 THB.
- The residence permit fee for spouses and children (under 20 years of age) of aliens who already had the residence permit or Thai citizens is 95,700 THB.
- Endorsement 1,900 THB.

What if I want to leave Thailand temporarily?
After you obtain the Residence Certificate in Thailand, it is perpetually valid until you have left Thailand. Then the residence certificate shall no longer be valid anymore. Therefore, if you wish to leave Thailand not over 1 year, then you must bring your residence certificate to make evidence of notification for leaving the Kingdom in order to re-enter according to the Immigration Act as follows:
- Present the residence certificate to the competent official for endorsement of departure and re-entry notification
- In a case where no residence certificate is available as the alien has beenpermitted to stay in the Kingdom prior to the stipulation of provisions requiring aliens to apply for residence certificate, the alien shall first apply for a residence certificate from the competent official and then proceed as provided in (1).
- In a case where there is no space left for the endorsement referred to in (1), the residence certificate holder shall first apply for a replacement of the residence certificate
How many times can I departure and re-entry Thailand?
The departure and re-entry notification shall be valid for one year from the
date the competent official has made the same and during that one year period the holder of the residence certificate can make as many departures and re-entries as desirable.
